Azerbaijan introduces draft laws to regulate AI-generated content

Azerbaijan has introduced draft laws aiming to control the creation and distribution of artificial intelligence-generated content. The proposed legislation, submitted to the Parliament, seeks to criminalize the production of sexually explicit material using AI without consent, carrying potential prison sentences of up to seven years. Another key provision mandates that all AI-generated content must be clearly labeled as such.

Parliament committees discussed these bills on Thursday, with APA reporting that the labeling requirement is intended to ensure the content’s origin is transparent. Failure to properly label AI-generated content would result in fines ranging from 80 to 150 dollars. Information Communication Technologies expert Osman Gunduz highlighted a growing concern regarding deepfakes within Azerbaijan.

He noted that worldwide, reputational attacks and sexual blackmail have become significant issues due to advancements in AI manipulation. Many nations are developing legal frameworks to address these risks, emphasizing the need to safeguard privacy, reputation, and information security. However, Gunduz cautioned about the potential challenges of implementing labeling mechanisms within the media environment, suggesting that a poorly structured approach could create legal complications for news production.

He questioned how the authenticity of AI images would be verified, what labeling standards would apply, and how the effectiveness of these measures would be assessed. Human rights lawyer Yalchin Imanov stated that Azerbaijan’s current legislation does not regulate AI-generated content, marking the country’s initial attempt to address this issue. He expressed uncertainty regarding the laws’ practical implementation, citing a history of selective enforcement.

Concerns exist that the vague wording could further restrict freedom of expression. The debate centers on balancing the protection of citizen rights and innovation with the potential for bureaucratic obstacles and uneven enforcement within azerbaijan.
